Minnesota Child Visitation Lawyer
Serving Clients Throughout the St. Cloud-Princeton Area and Beyond
One of the most important tasks in any divorce, separation or dissolution of a partnership in which children are involved is to establish a schedule for the time you will spend with your children.
Family law courts and child psychologists generally agree that an equitable visitation agreement is often the best thing for children involved in a divorce. In our experience, arriving at that agreement amicably is preferable to potentially lengthy and costly litigation.
At Thompson Legal Services, we favor a mediated resolution to disputes over custody and visitation — technically known as "parenting time" in our state. Whether you are divorcing or you are in need of a modification to a preexisting order, we will take a close look at your child custody plan and overall family situation in order to help you establish a visitation plan that works.
The way parents handle the resolution of custody and visitation matters can have a dramatic impact on how well a child copes with the emotional upheaval of a divorce or separation. The team at Thompson Legal Services works with families of all kinds throughout Minnesota to resolve child visitation matters. You May Need an Attorney to Obtain a Modification of Visitation
Once a custody and visitation or parenting time plan is memorialized in a court order, it will almost certainly be necessary to obtain a formal modification of that order prior to making any significant changes in the plan. Modification of this sort is appropriate when there has been a substantial change in your circumstances since the original order was signed. Modifications to custody and visitation plans can be granted for many reasons, including:
- Relocation for work
- One party has a new partner or remarries
- Issues of parental behavior, such as drug or alcohol abuse or allegations of neglect
- Change in health of co-parent or child
- Problems at school
- Changing schools
- The child's preference, if he or she is of sufficient age
As with the initial establishment of a custody and visitation plan, any modification should be approached from the perspective of what is in the best interests of the child or children in question. Mediation may offer an effective means of coming to a mutual agreement in such a way as to minimize the negative impact on a child of potentially upsetting changes in routine.
